Mumbai | State liable to reimburse private unaided schools, says high court

Mumbai: In a landmark order, the Bombay high court on Tuesday held that the state was liable to reimburse private unaided schools for the free education that they provide to students from economically weaker sections in pre-primary classes under the Right To Education Act.

With the Centre as well as the state government attempting to put the onus of reimbursing fees on each other, a division bench of Justice Anoop Mohta and Justice K R asked them not to “shirk responsibility”.

“The appropriate government cannot shirk their responsibilities by saying that they are under no obligation towards pre-primary education,” observed the judges.
